The City of Prescott is currently involved in a legal matter that has received a lot of public and media attention. Although the City typically does not comment on ongoing court cases, we recognize the high level of interest and want to provide residents with a straightforward update.
The Arizona Court of Appeals recently issued a ruling that confirms Councilmember Patrick Grady will continue to serve on the Prescott City Council. This ruling is part of a legal challenge brought by an applicant for a vacant Council seat that was ultimately filled by Councilmember Grady.
Since the case began, the Plaintiff has filed two lawsuits in the Yavapai County Superior Court, two special action petitions to the Arizona Court of Appeals, and two petitions for review to the Arizona Supreme Court. Within these matters, the Plaintiff has filed numerous motions and made a multitude of requests which have been denied. So far, the courts’ rulings have been overwhelmingly in favor of the City of Prescott.
The City remains committed to respecting the law and maintaining the trust of its residents. We will continue to participate in the legal process until it is fully resolved and plan to request reimbursement of attorney’s fees from the Plaintiff as allowed by law in order to protect taxpayer dollars.
