Right of Way Permits

Right of Way Permits

A permit is required whenever work is performed within any public street, highway, alley, sidewalk or other platted or written easement, otherwise known as the “right-of-way”, which has been dedicated to, or accepted by, or acquired by, the City for public purposes. 

Examples of work include, but are not limited to, all improvements and tie-ins to city streets, driveways, sidewalks, drainage culvert and infrastructure, water, sewer and dry utilities.

STEP ONE: GATHER ALL MATERIALS

Please gather the following information before submitting your application:

  1. The type of work to be performed (utility cut, driveway apron, curb replacement, etc.)
  2. When the work will be done (some work may take several days)
  3. Who will be performing the work (in most cases a licensed and bonded contractor is required with proper credentials held with the registrar of contractors) the contractor’s license number
  4. Where the work is to be done in relation to the ROW (behind curb, across the entire roadway, etc.).
  5. A Traffic Control Plan (in conformance with the Manual of Uniform Traffic Control Devices) must be submitted with the permit application.  Sample “Traffic Control Plans” are available for use BELOW, when they have been modified to represent the existing conditions of the proposed permit.

STEP TWO: APPLY FOR A PERMIT

Visit prescottpermits.com to submit your application. If you do not already have an account, please follow the steps listed here.
 

STEP THREE:  SCHEDULE AN INSPECTION

24 hours prior to the start of work, an inspection must be scheduled with the Public Works Department via prescottpermits.com.
 

Please allow 3-5 business days for processing.  There is a $50 fee for the issuance of all Right-of-Way Permits.  Other fees may apply depending on the extent of the work.  E.g. grading, sewer tap, water tap, etc. 

All work in the right-of-way shall be built to Prescott City Code, Title 17, General Engineering Standards (GES)

Pavement Restoration Fees

All sidewalk and pavement cut activity shall have an approved permit. If a proposed activity, use or encroachment includes cutting into, attachment to or any break in the sidewalk or street pavement, the Permittee shall be required to pay a pavement damage fee established by the City and to restore the pavement in accordance with this chapter and all other City standards and specifications. Other fees, charges or taxes may be imposed depending on the use made of a City street or highway.

Fee Breakdown

The Pavement Restoration Fee shall be paid at the time a permit is issued.

Pavement Restorations Fees shall be determined as follows:

Pavement Age:  Less than 12 months (0-1 years)

Cut Size

< 200 SY

> 200 SY

Fee

$1,800 + $20/SY

$1,800 + $18/SY

For cuts within the first year, the fee is in addition to the mill and overlay

Pavement Age: 12 months – 24 months (1-2 years)

Cut Size

< 200 SY

> 200 SY

$1,600 + $20/SY

Pavement Age: 24 months – 36 months (2-3 years)

Cut Size

Pavement Age

Permission to excavate in new streets (first constructed, when it is reconstructed, or when it is rehabilitated) shall not be granted for two (2) years after completion of street construction, reconstruction or rehabilitation. Utilities shall determine alternate methods of making necessary repairs to avoid excavating in new streets. Exceptions to the above are as follows:

  1. Emergency which endangers life or property
  2. Interruption of essential utility service
  3. Where no other feasible means of providing service exists
